I, Rose Edwards, hereinafter termed the breeder and _______________________of __________________________________________ hereinafter termed the buyer, on this _____ day of _______, 20_____, agree to sell according to the terms listed below a Male/Female Yorkshire Terrier, whelped on ____________, sired by _______________________ & out of ________________________

The mutually agreeable purchase price shall be $ ________ plus any respecting clause(s) listed below and the purchase price shall be paid in full to breeder on or before the dog leaves the breeders possession.  A non-refundable deposit of $50.00 is required to hold your dog. Payment options are cash, credit card, & PayPal. There is a 4% service charge for payments other than cash, NO exceptions. ALL pet quality dogs are sold on a AKC limited registration.

The buyer has (2) two weeks to visit a veterinarian of their choice to verify the health of said dog. Should said dog not be in good health, the breeder will, upon presentation of a veterinarian report stating such, and the return of said dog within 2 days of the dated vet report, refund the purchase price to the buyer. EXCEPTIONS: Hypoglycemia or luxating patella’s, internal or external parasites including; coccidiosis & Giardia are not covered in this health guarantee, nor are any non-congenital problems.

Furthermore, said dog is guaranteed against any congenital disease that proves fatal within 2 years from the date of purchase. Upon presentation of a copy of the veterinarian certified autopsy report stating cause of death as being solely congenital, said dog will be replaced with a similar quality dog as soon as possible, there will be no money refunded.

The buyer will take excellent care of said dog, which includes insuring it has plenty of food and water, regular medical check-ups, including all necessary vaccinations. All maintenance and veterinary expenses will be the responsibility of the buyer for the life of said dog from the date of possession.  X________

The buyer may return the dog within 1 week, for a full refund, provided the dog is in the same condition it left the breeder and not registered in the buyer’s name. The buyer is not to sell, lease, give away or otherwise dispose of said dog in any way. If the buyer in good faith feels that he/she cannot fulfill these obligations the said dog MUST be returned to the breeder with all paperwork, including; registration papers signed over to the breeder, vaccination records, etc., and there will be no monies refunded to the buyer. EXCEPTION: If the breeder is able to place said dog with another party within one month of being returned, no more than 70% of any funds received will be refunded to the purchaser within 4 weeks of date of subsequent sale.  X________

SPAY/NEUTER AGREEMENT: Said dog is being sold as “PET QUALITY” and under NO CIRCUMSTANCES is to be bred.  The spay/neuter should to be performed on the breeder’s earliest recommendation date, at the buyer’s expense. The buyer agrees that sterilization is part of the requirement to complete the purchase of said dog. This transaction will only be deemed complete upon presentation to the breeder of proof of spay/neuter by way of a veterinarian certificate identifying said dog. X________

LIQUIDATED DAMAGES: The failure to comply with any of the above terms and conditions not only voids all guarantees but carries a liquidation damage of Nine thousand ($9000.00) dollars. In addition, the buyer MUST return said dog and transfer ownership of said dog back to the breeder immediately. X________

This agreement is governed under the laws of the State of Michigan and may not be altered, modified or rescinded unless agreed to in writing by Buyer and Seller, and any actions resulting from non-compliance of the agreement will be settled in the County of Baraga, in the State of Michigan. Purchaser will be held liable for all legal fees and court costs. Any placement costs, maintenance costs, boarding, medical and associated miscellaneous costs related to this puppy/dog will be the responsibility of Buyer. X________

The buyer agrees to the terms & conditions of this contract by duly reading & acknowledging each clause above with their initials. The intent of this contract is to ensure a mentally and physically healthy and happy dog who will never be bred and will be returned to the breeder if the buyer cannot keep the dog. This contract is considered binding by both parties and can only be altered by mutual consent.

IN WITNESS WHEREOF, the parties have signed this Contract as of the date set forth above.
